1. How to Submit a DMCA Takedown Request (USA)

Peel Development respects the intellectual property rights of others. Per the DMCA, we will respond expeditiously to claims of copyright infringement on the Site if submitted to our Copyright Agent as described below. Upon receipt of a notice alleging copyright infringement, We will take whatever action it deems appropriate within its sole discretion, including removal of the allegedly infringing materials and termination of access for repeat infringers of copyright-protected content. Biffen may request additional information before removing any allegedly infringing material. In the event we remove the allegedly infringing materials, we will immediately notify the person responsible for posting such materials that we removed or disabled access to the materials. We may also provide the responsible person with your email address so that the person may respond to your allegations. Pursuant to 17 U.S.C. 512(c).

 

2. Counter-Notification Process

If you believe that content you posted on Biffen was removed in error or is not infringing, you may submit a counter-notification. Your counter-notice must include:

1. Identification of the removed content and its previous location.
2. A statement, under penalty of perjury, that you have a good faith belief that the content was removed due to a mistake or misidentification.
3. Your contact information, including your full name, address, phone number, and email.
4. A statement consenting to the jurisdiction of the federal court in your district (if you are in the U.S.) or your location (if outside the U.S.).
5. Your physical or electronic signature.

We will forward your counter-notification to the original claimant. If they do not file a lawsuit within 10 business days, we may restore the removed content.
